1. Introduction

Welcome to KhayaCONNECT (PTY) Ltd ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your purchase of leads from us. By purchasing leads, you agree to comply with and be bound by these Terms. 

2. Definition of Leads

"Leads" refers to contacts, such as names, phone numbers, email addresses, and other personal information that may indicate interest in a specific product or service. 

3. Compliance with POPIA

In compliance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA), KhayaCONNECT (PTY) Ltd is committed to protecting the personal information of individuals. As a buyer of leads, you agree to: 

• Use the leads obtained from us only for legitimate business purposes and in compliance with applicable data protection laws.

• Ensure that the processing of personal information obtained from the leads aligns with the conditions for lawful processing as set out in POPIA.

• Obtain consent from individuals if required and provide them with the required information as per POPIA prior to processing their personal information.

4. Purchase of Leads

• When you purchase leads from KhayaCONNECT (PTY) Ltd, you will receive a specified number of leads as detailed in your order.

• All sales of leads are final, and no refunds will be provided once the order has been confirmed, except as stated in these Terms.

5. Payment Terms

• All payments must be made in South African Rand (ZAR) and are due upon order confirmation, unless otherwise agreed.

• We reserve the right to suspend or cancel the processing of leads if payment is not received in full.

6. Intellectual Property

All intellectual property rights in the leads and any associated materials (including but not limited to databases, reports, and marketing materials) remain the property of KhayaCONNECT (PTY) Ltd. You are granted a limited, non-exclusive, non-transferable license to use the leads solely for registering the lead into Train a Connector (TAC). 

7. No Guarantee of Conversion

KhayaCONNECT (PTY) Ltd does not guarantee that leads will convert into sales or that they will meet the specific needs of your business. The success of leads depends on various factors beyond our control, including your personal approach and constant communication with the lead. 

8. Limitation of Liability

To the fullest extent permissible by law, KhayaCONNECT (PTY) Ltd shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of leads purchased from us. This includes loss of profits, data, or other intangible losses. 

9. Confidentiality

You agree to treat as confidential any information pertaining to the leads and shall not disclose it to any third party without the prior written consent of KhayaCONNECT (PTY) Ltd, except as required by law. 

10. Termination

We reserve the right to terminate your access to leads and our services at any time, with or without cause, and with or without prior notice. Upon termination, any obligations and liabilities incurred prior to termination will survive. 

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of South Africa. 

12. Changes to These Terms

KhayaCONNECT (PTY) Ltd reserves the right to modify these Terms at any time. Any changes will be posted on our website, and your continued use of our services after any changes signifies your acceptance of the revised Terms.
